5am – A/B/C Who Says Supreme Court Justices Get Lifetime Tenure? (New Republic) Should justices have term limits? The Constitution, most people believe, mandates that judges be appointed to the bench for life, unless they commit a crime or other impeachable offense. As only one Supreme Court justice has ever been impeached—Samuel Chase in 1803—and none convicted, removal for cause is unlikely at best. Because it is assumed lifetime tenure is enshrined in Article III, any attempt to alter that arrangement would require an amendment, another unwieldy and improbable prospect. But the Constitution enshrines no such thing, at least not overtly.

5am – D CNN Panel Mocks Kanye West as Trump’s ‘Token Negro,’ Don Lemon Laughs (The Wrap) A CNN panel hosted by anchor Don Lemon took turns lacing into Kanye West on Tuesday evening, joking that his embrace of President Donald Trump has caused him to be tokenized. Several referred to him using the term “negro.” “He’s an attention whore, like the president. He’s all of a sudden now the model spokesperson. He’s the token negro of the Trump administration,” said CNN contributor Tara Setmeyer. “This is ridiculous and no one should be taking Kanye West seriously. He clearly has issues. He’s already been hospitalized,” she continued.  “Not to trivialize mental health issues, [but] obviously Kanye has taken a turn in a very strange way.”

5am – E Judicial Watch Uncovers More Classified Material on Hillary Clinton’s Unsecure Email System Judicial Watch announced today that it received 288 pages of newly uncovered emails of former Secretary of State Hillary that were transmitted over her unsecure, non-“state.gov” email system, three of which contain classified information.

6am – A Obama AG Eric Holder Questions Legitimacy Of Supreme Court, Calls On Democrats To ‘Use Rage To Vote To Be Rid Of These People’ (Daily Wire) Barack Obama’s attorney general Eric Holder is fuming over the confirmation of Supreme Court Justice Brett Kavanaugh. So angry is the one-time top lawman that he questions the legitimacy of the highest court in America — simply because a fairly-elected Republican president installed a conservative judge. And he wants everyone who opposed Kavanaugh to use their “rage” to “be rid of these people.” Former Obama Attorney General Eric Holder tells a crowd to “kick” Republicans at a rally in support of Democratic gubernatorial candidate Stacey Abrams in Stockbridge, Georgia on October 7, prompting the crowd to cheer and chant “fight” in response.

6am – C Jennifer Garner ‘relieved’ Ben Affleck divorce is finalized and is open to dating, source says (Fox News) With Jennifer Garner’s divorce from Ben Affleck finally behind her, she’s ready to live her life on her own terms. Three years after the “Peppermint” actress and Affleck, both 46, first announced their split, Garner couldn’t be happier to put it all behind her. “Jennifer is relieved her divorce is finalized and is really looking forward to closing that chapter of her life,” a source close to the Hollywood staple told Fox News on Wednesday. “She’ll always be there for Ben and will continue to support him through his ongoing fight in his quest for sobriety.”

6am – D Rosenstein will not meet with House lawmakers on Thursday (Washington Examiner) Deputy Attorney General Rod Rosenstein will not meet with House lawmakers Thursday, according to a source familiar with the matter. Rep. Mark Meadows, North Carolina Republican, said last week two House committees investigating the FBI and Justice Department could meet with Mr. Rosenstein Oct. 11. But an aide to one of those committees told The Washington Times that no meeting date has been scheduled.

6am – E  Colin Kaepernick Files Trademark for Image of His Face and Hair (Breitbart) Colin Kaepernick, former NFL quarterback and inventor of the national anthem protest, has filed for trademark protection for a graphic depiction of his face and hair, a report notes. The submission notes that the image is intended to be used for a wide variety of upcoming products including “everything from shampoo and hairspray to jewelry and lampshades.”

6am – F  Man shocked after selling girlfriend on eBay, bids reach $119,000 (New York Post) A British man is going viral online for trolling his girlfriend by putting her up for auction on eBay. Dale Leeks told CTVNews that he posted the ad as a joke after his better half, Kelly Greaves, recently whipped him on his butt at a horse riding shop. Leeks, a London-based landscaper, showed her the ad before going to dinner and laughed it off. But at their date, he noticed that his phone kept going off. Turns out, his tongue-in-cheek auction sparked a bidding war across Europe, Australia and the United States. And 24 hours later, when eBay removed the ad, bidding had reached $119,000. “I thought, ‘Oh no, what have I done?” he said. The post was seen more than 81,000 times, and eBay pulled the plug on it because it went against the policy of selling human body parts or remains.

8am – C  Emotional support squirrel gets woman kicked off flight, passengers cheer (New York Post) A passenger was booted from a Frontier Airlines plane in Orlando after she came aboard with a nutty companion — a squirrel that she insisted was her emotional support animal. The woman noted in her reservation that she was flying Tuesday night with an emotional support pet, but did not indicate that it was a squirrel, according to WKMG.
