WASHINGTON (WMAL) – Virginia Democrats continue to dispute the results of the 28th District House race. Some Democrats in Fredericksburg have filed a lawsuit asking a federal judge to call for a new election in that race. They say they and others were given the wrong ballots on election day.

“This is the only remedy for them. There’s no remedy in state law for a voter to have their ballot accurately counted,” said Trent Armitage, the executive director of the Virginia House Democratic Caucus.

Armitage said it’s incumbent upon the federal government to step in and require a new election to ensure the results are accurate.

The state board of elections certified the results of the election, which have Republican Bob Thomas beating Democrat Josh Cole by 82 points.

The race is one of a few crucial ones that could decide which party controls the Virginia House of Delegates.

The 40th, 68th and 94th District race results are being re-counted. This week it was decided the re-count for the 40th District seat would be done next Wednesday.

WMAL News has reached out to Republicans for comment but hasn’t heard back.
