D.C. Sniper Denied New Sentence in Montgomery County

WASHINGTON (WMAL) – Montgomery County Circuit Court judge denied D.C. sniper Lee Boyd Malvo’s request for a new sentence Wednesday.

Malvo’s attorneys argued his sentence for the 2002 deadly shooting rampage should be thrown out because the Supreme Court ruled mandatory life sentences for minors are unconstitutional. Malvo was 17 when he John Allen Muhammad went on their shooting spree across the D.C. metro area, killing 10 people and injuring three others.

Judge Robert Greenberg said Malvo’s sentence wasn’t mandatory but discretionary.

In his decision, Greenberg wrote the six consecutive life sentences without parole that a judge carefully considered Malvo’s physical, mental and emotional state before he handed down the sentence.

Meanwhile, a federal judge ruled Malvo is entitled to new sentencing hearings in Virginia.
