LISTEN: Election Law Expert J. CHRISTIAN ADAMS: States Have No Legal Basis to Defy Request from Trump’s Voter Fraud Commission

Listen as Larry spoke with J. Christian Adams, President of The Public Interest Legal Foundation (PILF) and former election lawyer in the Voting Rights Section at the U.S. Department of Justice, regarding states refusing to provide voter information to President Trump’s Voter Fraud Commission.

During the interview, Adams exposed the narrative used by states refusing to cooperate with President Trump’s Voter Fraud Commission:

O’Connor: I’m looking now at the state of Maryland. Maryland is the latest, Attorney General Frosh, of course we asked if the Attorney General would come on to talk about this he wouldn’t do it. We asked the Maryland State Board of Elections to come and they wouldn’t do it, though they did point us to a letter. And they said, “Your request is prohibited under §3–506 of the Election Law Article of the Maryland Annotated Code’. Now I took a look at that and I couldn’t see exactly what was against the Maryland State Code other than it says specifically, a Maryland state resident can request this voter information provided that it has to do with, they are asking for it for the electoral process. Is that what they’re claiming, that the reasons behind the request is not appropriate?

Adams: Yeah, not only that but it doesn’t matter what the Maryland code said Larry. Here’s the most important thing your listeners can understand, federal law trumps. Federal law is supreme to Maryland law. Even if there is a Maryland law that says you shall not cooperate with the Trump Voter Fraud Commission, it wouldn’t matter because federal law says that states upon request have to give this information to the federal government under federal code. And I know when I was in the Justice Department we brought cases like this, I think, against Alabama. They were refusing to give information, we sued them, and they gave the information.
