The Biden Administration said on Tuesday that it would appeal a U.S. Circuit Judge in Florida’s Monday ruling that brought an end to mask mandates on public transportation, if the CDC deems it necessary to stop the spread of the COVID-19 virus.
The Center for Disease Control and Prevention said that it would continue studying whether masks mandates are still needed. “We will continue to assess the need for a mask requirement in those settings, based on several factors, including the U.S. COVID-19 community levels, risk of circulating and novel variants, and trends in cases and disease severity,” said the CDC in a statement released Tuesday.
Following the ruling by U.S. District Judge Kathryn Kimball Mizelle that brought an end to mask mandates on the grounds that it was unlawful, the Department of Justice will be leading the appeal, if public health official determine the mask mandates are needed to stem the spread of the virus.
“The Department of Justice and the Centers for Disease Control and Prevention (CDC) disagree with the district court’s decision and will appeal,” the DOJ said in a statement, “subject to CDC’s conclusion that the order remains necessary for public health.”
