AG Miyares “Criminal First, Victim Last” Mindset Allowed Homeless Shooter on Streets

Virginia Attorney General Jason Miyares joined O’Connor & Company this morning to discuss the recent spree of homeless shootings in Washington, D.C. and New York. While the suspect is currently in custody, Miyares details why he was allowed to walk free on the streets despite a history of criminal activity.

The suspect Gerald Brevard, who was apprehended on Tuesday, has a long arrest record dating back to 2009. In 2020, he was charged with multiple crimes for attaching women in the Herndon area. In a plea deal, his felony charges for abduction with intent to defile and burglary were reduced to misdemeanors, and he served a total of 11 months in Fairfax County Jail before being release and sentenced to a year of probation.   

AG Miyares on the light sentence issues to Brevard by prosecutors in Fairfax County: “It goes to show you that eliminating criminal justice is not criminal justice reform.” He continued, “you have an example here of what I have said is a huge problem is this ‘criminal first, victim last’ mindset of prosecutors. The want to be prosecutors are failing at their jobs and now people are dying.”
