Fairfax County School Board Says Law Prohibiting Mask Mandates is Unconstitutional

The largest school system in the state represented by the Fairfax County School Board said they believe Governor Youngkin’s law prohibiting mask mandates is unconstitutional.

  • A federal judge: said Monday that they will consider allowing the Fairfax County School Board to file an amicus curiae brief to vocalize their support for the ACLU in this case.
  • What the school board is saying: “Among FCPS’ students with disabilities are hundreds and hundreds with serious medical conditions that render them at ‘high risk,’ for serious illness or death from respiratory infections such as COVID-19, according to CDC criteria.”
