LISTEN: Montgomery County Executive IKE LEGGETT Comments on the Release of an Undocumented Immigrant Suspected of Committing a Felony: We Made a Mistake


Listen as Larry spoke with Montgomery County Executive Ike Leggett regarding the release of an accused undocumented immigrant from jail despite an immigration detainer.

During the interview, O’Connor asked Executive Leggett about Montgomery County releasing Mario Granados-Alvarado from jail – an undocumented immigrant who allegedly broke into a police car stealing a shot gun, AR-15 weapon and ammunition.

O’Connor: So, did the Montgomery County policy, was it followed in this case?

Executive Leggett: I think we made a mistake in the interpretation of it. I think things moved a little too quickly, but it should not have happened. We are going back to make sure we properly review to make sure this kind of charge for an individual who is on the detainer would not and should not have happened.

O’Connor continued to press Executive Leggett saying:

O’Connor: Well, where did they go wrong?  My understanding, from the county’s policies, is that this sort of went right along with what the elected officials in Montgomery County have dictated.

Executive Leggett: Yeah, but in this case, given the serious nature of the multiple charges on it, it should not have occurred. And I think that’s the difference on it.

O’Connor: So what if he had been picked up for shoplifting.

Executive Leggett: Then now we would not had ordered a detainer for that no.

O’Connor: So a shoplifter you let free.

Executive Leggett: Yes, that’s right.

O’Connor: Do we have a list of laws in which…

Executive Leggett: I don’t have all of them in front of me, but I can tell you if it’s for a serious felony or felonies then we would honor the detainer. Generally, when we have those that are not serious or misdemeanors, which many are traffic violations and those kinds of things, we would not honor that unless there is something else with probable cause or something else or a more serious crime that it’s associated with.
