Second Suspect in Rockville High Rape Claims Sex Was Consensual

ROCKVILLE, MD — (WMAL) Both suspects in the March 16th alleged rape of a 14-year-old girl at Rockville High School now claim the sex was consensual.

Attorneys for Jose Montano, the younger of the two suspects in the case, claim the girl texted Montano the day before the incident and agreed to a sexual encounter with him during school, according to court documents filed Monday in the case. The court filing also asserts that the girl texted explicit images of herself to Montano.

The latest claim in the case mirrors that of the co-defendant, 18-year-old Henry Sanchez Milian, whose attorney also claims the sex in the case was consensual.

Police are standing by their case.

“The events were horrible. They were not consensual,” said Capt. James Humphries, commander of the Montgomery Police Department’s Special Victims Investigation unit in an interview with the Washington Post.

Even if the girl did reach out to one of the suspects, there’s still no indication she agreed to have sex with two people in a school bathroom stall, police argue.

Still, claiming his innocence, Montano’s attorneys are asking the court to review their client’s bond status.

Attorney Maria Mena told the Post her client doesn’t understand why he has been charged with a crime: “He comes from a wonderful, hard-working family who supports him 100 percent.”
